Escrow Services associated with the management of Associations include the Fees for the services of transferring Association home owners as covered in the Management Agreement.
The Management company is entitled to a fee called a Transfer fee payable by the Escrow Agent prior to and/or at close of escrow.
This fee shall include the preparation of the documents that are required by law to be furnished upon a transfer of a home, including CC&R, Bylaws, Articles of Incorporation, Rules and Regulations and the Association’s Budget.
The corresponding Disclosure Fee is deemed to occur when the Management company completes the Disclosure Process and/or when title to said lot/unit changes for any reason whatsoever.
This fee shall include the preparation of the documents that are required by law to be furnished upon a transfer of a home, including notification of any outstanding CC&R violations by the selling home owner, if any.
Sometimes defined separately, the Fee for an initial closing, from Developer/Declarant to first home owner is referred to as a Declarant Transfer Fee.
